Terms of Service

Omni Alerts ("the Service") is owned and operated by Atsap Holding Co LLC ("Atsap Holding Co LLC," "we," "us," or "our"). The Service aggregates and displays publicly observable retail inventory signals — including Pennsylvania Fine Wine & Good Spirits (FWGS) stock levels, theme park reservation availability, and retail collectible restocks — and notifies subscribed users when configured thresholds are met. The Service is an informational and notification tool only; it does not sell, reserve, or guarantee access to any product, allocation, or reservation.

All subscription charges are final. Omni Alerts does not issue refunds or prorated credits for any billing period, including but not limited to: missed alerts, delayed notifications, inaccurate inventory data, product sell-outs prior to purchase, store policy changes, or voluntary/involuntary cancellation mid-cycle. You may cancel future billing at any time from Settings; cancellation takes effect at the end of the current paid term.

Inventory, pricing, and availability data displayed within the Service is sourced from third-party systems not controlled by Omni Alerts and may be delayed, incomplete, duplicated, or incorrect ("ghost inventory"). Omni Alerts makes no warranty, express or implied, regarding the accuracy, timeliness, or completeness of any data shown. You are solely responsible for verifying real-world availability directly with the retailer before traveling to a store or attempting a purchase.

Omni Alerts is an independent, third-party monitoring and notification service. It is not affiliated with, sponsored by, endorsed by, or officially connected to Disney, Universal Destinations & Experiences, the Pennsylvania Liquor Control Board / Fine Wine & Good Spirits, Sazerac Company or Buffalo Trace Distillery, nor any airline, cruise line, ski resort, restaurant, or other brand referenced within the Service. All product names, logos, and brands mentioned are the property of their respective trademark owners and are used solely to identify the retailers and products the Service monitors. Use of these names does not imply any relationship, sponsorship, or endorsement between Omni Alerts and the referenced companies.

You must be at least 18 years old to create an Omni Alerts account. Access to alcohol-related tracking channels (e.g. the Rare PA Spirits & Bourbon Drops niche) additionally requires that you affirmatively verify you are 21 years of age or older, consistent with U.S. alcohol marketing regulations. Omni Alerts reserves the right to suspend accounts that misrepresent age eligibility.

Users who sign up via a valid influencer referral code have that code permanently associated with their account. Commission payouts to referral partners are governed by a separate independent-contractor agreement and are not a benefit owed to the referred subscriber.

You may not use the Service to automate, resell, or redistribute alert data at scale, to circumvent retailer purchase limits, or for any unlawful purpose, including underage alcohol procurement.

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Omni Alerts does not warrant that alerts will be timely, uninterrupted, or error-free, or that any tracked product, reservation, or deal will actually be available when you act on a notification.

To the maximum extent permitted by law, Atsap Holding Co LLC, its officers, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from use of, or inability to use, the Service, including travel costs, lost time, or expenses incurred pursuing a false, delayed, or expired alert. Regardless of the legal theory asserted, Atsap Holding Co LLC's total aggregate liability to you for all claims arising out of or relating to these Terms or the Service will not exceed the greater of (a) fifty U.S. dollars ($50), or (b) the total amount you paid Atsap Holding Co LLC in the three (3) months immediately preceding the event giving rise to the claim.

You agree to indemnify and hold harmless Atsap Holding Co LLC and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party, including any retailer's terms of sale or purchase-limit policies.

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms, misrepresents age eligibility, or that we believe is harmful to other users, retailers, or Atsap Holding Co LLC. You may stop using the Service and cancel your subscription at any time from Settings. Provisions that by their nature should survive termination — including Data Accuracy Disclaimer, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law — will survive.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Pennsylvania, and you consent to personal jurisdiction there.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Atsap Holding Co LLC regarding the Service. We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
